Overview
These Terms of Service (“Terms”) govern your access to and use of the Canadian Optics website, store, and related services (collectively, the “Services”). “Canadian Optics,” “we,” “us,” and “our” refer to 1536729 Alberta Ltd., operating as Canadian Optics. The Services are hosted and powered by Shopify.
By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Access & Account
You represent you are at least the age of majority in your province (or have obtained consent for any permitted dependent use on devices you own/manage). You agree to provide accurate, current, and complete registration, billing, and shipping information, and to maintain the security of your account credentials. You may not transfer or license your account to others.
2. Our Products
We strive to depict products accurately; however, appearance (including colour) may vary due to device settings and configurations. Descriptions, pricing, and availability may change without notice. We may limit quantities and discontinue products at our discretion.
3. Orders & Acceptance
Your order is an offer to purchase. We may accept, decline, cancel, or modify an order in our discretion, including for availability, errors, or suspected fraud. Your order is accepted only after payment is processed and acceptance is confirmed. Returns and exchanges are governed by our Refund & Returns Policy [LINK]. You represent purchases are for personal or household use and not for resale or export.
4. Prices, Billing & Payment
Prices, promotions, and discounts may change without notice. Unless expressly stated, prices exclude taxes, shipping, handling, customs, and import duties. You agree that (i) your payment information is true and complete; (ii) you are authorized to use the payment method; (iii) charges will be honoured; and (iv) you will pay all amounts due, including applicable taxes and fees.
5. Taxes & Duties
You are responsible for all applicable sales taxes, VAT/GST, customs duties, and import fees for your order, including international shipments when available.
6. Shipping
Shipping is governed by our Shipping Policy. Title and risk of loss pass to you when we deliver goods to the carrier. Delivery times are estimates only. Remote or rural areas may incur additional surcharges or longer delivery times.
7. Export Restrictions
Certain products, including thermal optics and body armour, may be subject to Canadian export laws and international trade regulations. You agree not to export or re-export any product in violation of applicable laws.
8. Legal Compliance (Thermal Optics & Body Armour)
Thermal Optics. Thermal imaging devices are sold for lawful use only. You are responsible for ensuring compliance with all federal, provincial, territorial, and local laws, including import/export restrictions. We do not guarantee legality for hunting or surveillance in your jurisdiction.
Body Armour (Alberta). In accordance with the Alberta Body Armour Control Act, body armour may only be sold to individuals with a valid Body Armour Permit or otherwise authorized (e.g., licensed security personnel, law enforcement, or holders of a valid PAL). By purchasing, you confirm: (i) you are at least the age of majority; (ii) you are legally permitted to purchase and possess body armour in your province; (iii) you will provide valid documentation upon request; (iv) you are not purchasing on behalf of another to circumvent legal requirements; and (v) you assume all responsibility for use or misuse.
9. Optional Tools
We may provide access to third‑party tools “as is” and “as available” without any warranties or endorsements. Your use is at your own risk, and you should review the third party’s terms.
10. Third‑Party Links & Content
The Services may link to or embed third‑party sites, services, or content. We are not responsible for evaluating or monitoring third‑party materials and disclaim liability for your use of them. Review the third party’s policies before engaging in transactions.
11. Relationship with Shopify
Canadian Optics uses Shopify to host and power the Services. All sales are with 1536729 Alberta Ltd. (Canadian Optics). Shopify is not a party to your transactions and bears no responsibility for any sales between you and us. You release Shopify and its affiliates from claims arising from or related to your purchases and transactions with Canadian Optics.
12. Privacy
Personal information collected through the Services is governed by our Privacy Policy. Because the Services are hosted by Shopify, certain information may be processed pursuant to Shopify’s Privacy Policy. Information you submit may be processed in countries outside your residence to provide and improve the Services.
13. Intellectual Property
All content, trademarks, trade dress, graphics, logos, text, images, video, audio, code, and arrangements on the Services are owned by 1536729 Alberta Ltd. or our licensors and are protected by applicable intellectual property laws. You may use the Services for personal, non‑commercial purposes only. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works, publicly display, perform, republish, download, store, or transmit any materials without our prior written consent. All rights not expressly granted are reserved.
“Shopify” and related marks are trademarks of Shopify Inc. and its affiliates. Canadian Optics marks are trademarks of 1536729 Alberta Ltd. Other marks belong to their respective owners.
14. User-Generated Content & IP Reporting
If you submit reviews, photos, or other content, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display such content. If you believe your intellectual property rights have been infringed, contact us at support@canadianoptics.com with details.
15. Feedback
If you submit ideas, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty‑free license to use, reproduce, modify, publish, and display such Feedback for any lawful purpose. You represent you own or control rights in the Feedback, have disclosed any compensation, and that your Feedback complies with these Terms.
16. Prohibited Uses
You may not use the Services: (a) unlawfully or maliciously; (b) to violate any law; (c) to infringe IP or privacy rights; (d) to harass, defame, or threaten; (e) to transmit false or misleading information; (f) to upload non‑compliant content; (g) to send spam or similar solicitations; (h) to impersonate others; (i) to restrict or inhibit others’ use; (j) to upload viruses/malicious code; (k) to scrape or collect personal information; (l) to bypass security; or (m) to reproduce, sell, or exploit the Services. We may suspend or terminate access for violations.
17. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, supply chain disruptions, or government actions.
18. Termination
We may terminate or suspend the Services or your access at any time, without notice. Sections that by their nature should survive termination will continue (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, and Privacy).
19. Disclaimer of Warranties
Except as expressly stated by us in writing, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non‑infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error‑free. Some jurisdictions do not allow certain disclaimers; your rights may vary.
20. Limitation of Liability
To the fullest extent permitted by law, in no case shall 1536729 Alberta Ltd. (Canadian Optics), our directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, revenue, savings, data, replacement costs, or similar, arising from your use of the Services or products, or any content, even if advised of the possibility. Our aggregate liability to you for claims will not exceed the amount you paid for the product(s) giving rise to the claim.
21. Indemnification
You agree to indemnify, defend, and hold harmless 1536729 Alberta Ltd. (Canadian Optics), Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of (i) your breach of these Terms or referenced policies; (ii) your violation of law or third‑party rights; or (iii) your access to or use of the Services. We may control the defence and settlement; you will cooperate.
22. Errors, Inaccuracies & Omissions
Information on the Services may contain typographical errors or inaccuracies (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct errors and update or cancel orders due to inaccuracies, including after submission.

24. Dispute Resolution & Language Clause
Any disputes will first be subject to informal resolution. If unresolved, disputes shall be settled by binding arbitration in Alberta, Canada, under applicable arbitration rules. These Terms are governed by English language, which prevails in case of translation discrepancies.
25. Severability
If any provision is found unlawful, void, or unenforceable, that portion is severed to the extent necessary, and the remainder remains in effect.
26. Waiver; Entire Agreement
Our failure to enforce any right or provision is not a waiver. These Terms and any policies posted to the Services constitute the entire agreement between you and us and supersede prior communications.
27. Assignment
You may not delegate, transfer, or assign these Terms without our prior written consent. We may assign or delegate these Terms without notice.
28. Governing Law & Venue
These Terms and any separate agreements for Services are governed by the laws of Canada and the province/territory or state where Canadian Optics (1536729 Alberta Ltd.) is headquartered. You and Canadian Optics consent to venue and personal jurisdiction in the federal, provincial/state, or territorial courts of that location.

You can review the most current version of the Terms at any time on this page. We may update these Terms by posting changes. We will notify you of material changes as required by law. Your continued use of the Services after changes constitutes acceptance.
